REGULAR MEETING

 

The regular meeting of the City of Beacon Council held at the Municipal Center, One Municipal Plaza on March 19, 2007 immediately following the Traffic Safety Committee Meeting was called to order at 7:30 p.m. by Mayor Clara Lou Gould with the Pledge of Allegiance to the Flag.

 

Council Members Present:                               Elizabeth Foster, Charles Kelly, Phil Shea, Steve Gold and Eleanor Thompson.

Community Segment:            Juleann Cobb – Recreation Department

 

Ms. Cobb gave her 2006 Annual Report, which consisted of nine pages describing a vast number of activities, which are available to Beacon residents.  She answered the questions asked by the Beacon Council members.  She talked about relationships with venders, service providers, grants, etc. and how the Recreation Department is run.  She wanted to clear up any misunderstandings regarding the responsibilities of the Recreation Department.

 

She distributed a copy of a flyer for the REE-PLAY SALE set for Saturday, May 5th from 10:00 am to 1:00 pm.- at the Memorial Building at Teller and Main Street in Beacon.  They are asking for donations of children's clothing, toys, baby furniture, books, music, movies, games, maternity clothes (no stuffed animals, stained clothing, or adult clothing).  These items will be used in the Ree-Play Sale.  For donations for pick-up or drop-offs, call Claire Browne at 845-440-6072 for appointment.

Patrick Kelliher: We were asked to look at the agreement with Downstate and we all agreed that this is the wrong thing to do.  I want to offer my services if anyone who has any questions.  Going back 10 years, we did it for $15,000.  They tie up your equipment and if you have to hire a fire service to cover the City of Beacon, you have to hire enough men and equipment to cover your city.

 

Kathryn Deutermann: I would like to thank the city council for their cooperation.  Mrs. Carp did an excellent job in her presentation here tonight.  The city is growing.  The time put into this program by the recreation director is probably not enough.  She needs more time to do this job and to keep it going.

NEW BUSINESS

 

Resolutions:

 

1.  Resolution No. 54 of 2007 - Authorize to Accept the Dutchess County 2007 Stop-DWI Enforcement Program Funding in the Amount of $4,000 for the City of Beacon Police Department.  See Attached Read by City Administrator, Joseph Braun.

 

Scope of Service:

It is the intent of the Program to reduce the amount of alcohol-related crashes in the area covered by the enforcement agency.

 

The Contractor, in implementing this program, shall:

 

1.      Assign additional patrols it determines necessary to carry out the intent of the program with specific emphasis placed on locations, days, and hours (PATROLS MUST NOT COMMENCE BEFORE MIDNIGHT.) statistically high in alcohol-related crashes and previous DWI arrests.

2.      Assigned patrols under this contract shall be in addition to regular police coverage at the specific hours patrolled and must constitute "overtime" which shall be determined for the purposes of this contract as hours performed in addition to those normally performed on the particular date or time of day, special circumstances excluded.

3.      The contractor shall provide the County with access to all manpower records and provide such documentation as shall be required by the County to establish hours qualifying for reimbursement.

4.      The contractor shall furnish the Program Coordinator with monthly reports of arrests and dispositions of all DWI and related cases from the prior month, if needed.

5.      Performance Goal: Maintenance of effort.

 

CONTRACT FISCAL BREAKDOWN:

 

OVERTIME STOP-DWI PATROLS                                                            $3,200.00

 

FRINGE BENEFITS ON OVERTIME STOP-DWI PATROLS                      $ 800.00

(25% rate)

Authorize Mayor to Approve Application For And Willingness To Accept The Dutchess County 2007 STOP-DWI Enforcement Program Funding in the amount of $4,000.00 for the City of Beacon Police Department.

 

RESOLVED, That Application For, And Willingness To Accept The Dutchess County 2007 Stop-DWI Enforcement Program Funding in the Amount of $4,000.00 For The City Of Beacon Police Department Is Hereby Authorized.

 

Motion to authorize Mayor to approve application for and willing to accept Dutchess County 2007 Stop DWI Enforcement Program: Council Member Gold.  Seconded:  Council Member Thompson.  On a roll call vote, all voted in favor.  Motion carried.

 

2.  Resolution No. 55 of 2007 - Authorize Mayor to sign Proposal with McLaren Engineering Group for the Beacon Vessel Siting Study and Docking Design (RFP submitted).  Read by City Administrator, Joseph Braun.

 

WHEREAS, the RFP has been submitted for the Vessel Siting Study and Docking Design by McLaren Engineering Group, 100 Snake Hill Road, West Nyack, New York 10994 to provide engineering services to the City of Beacon Vessel Siting Study and Docking Design.

 

RESOLVED, that the City Council authorizes the Mayor to sign contract with McLaren Engineering Group, 100 Snake Hill Road, West Nyack, New York 10994 to provide engineering services to the City of Beacon Vessel Siting Study and Docking Design.

 

Motion to authorize Mayor to sign proposal:  Council Member Thompson.  Seconded:  Council Member Foster.  On a roll call vote, all voted in favor.  Motion carried.

 

3.  Resolution No. 56 of 2007 - Authorizing Mayor to sign Agreement regarding Renting University Settlement Camp Pool Facility for 2007 Season, in addition approving the funding for purpose in an amount to be present in a Budget Amendment.  Read by City Administrator, Joseph Braun

 

NOW, THEREFORE, be it

 

RESOLVED, that the City of Beacon shall enter into an agreement with the University Settlement Camp to rent the pool for the 2007 Season and the Mayor is authorized to sign said agreement; and, be it further

 

RESOLVED, that the Council approves the funding for same purpose in an amount to be presented in a Budget Amendment.

 

 

Motion to authorize Mayor to sign agreement and approve funding:  Council Member Thompson.  Seconded:  Council Member Shea.  On a roll call vote, all voted in favor.  Motion carried.

 

4.  Resolution No. 57 of 2007 - Authorize Mayor to Sign Agreement with County of Dutchess - 2007 Community Development Block Grant Program.

 

RESOLVED, that the City Council authorizes the Mayor to sign agreement and accept funds between City of Beacon and the County of Dutchess for the 2007 Community Development Block Grant Program Year 2007.

 

Motion to authorize Mayor to sign agreement with County of Dutchess:  Council Member Thompson.  Seconded:  Council Member Foster.  On a roll call vote, all voted in favor.  Motion carried.

 

5.  Resolution No. 58 of 2007 - Special Use Permit - Artist Workshop – 18 Overlook Avenue – David Clark.  Set Public Hearing for Monday, April 2, 2007.  Will discuss further at March 26, 2007 Workshop.

6.  Resolution No. 59 of 2007 - Special Use Permit - Wine Bar - 173 Main Street - Marcilac, Inc. (Building Owned by Skender Berisha).  Set Public Hearing for Monday, April 2, 2007.  Will discuss further at March 26, 2007 Workshop.

7.  Resolution No. 60 of 2007 - Approving The Memorandum Of Agreement Between The City Of Beacon And The City Of Beacon Police Benevolent Association.

 

WHEREAS, a new Memorandum of Agreement has been negotiated between the City of Beacon and the City of Beacon Police Benevolent Association for the term January 1, 2007 through December 31, 2009, now therefore, be it

 

RESOLVED, the City Council approves the Memorandum of Agreement between the City of Beacon and the City of Beacon Police Benevolent Association for the term January 1, 2007 through December 31, 2009 (a copy of said Memorandum of Agreement is attached to this resolution and expressly made a part hereof) and authorizes the Mayor to sign whatever documents are necessary in order to finalize the Agreement.  Contract will not be effective until in writing and all contract language is approved by City of Beacon and Beacon Police Benevolent Association.

 

MEMORANDUM OF AGREEMENT By and Between City of Beacon And Patrolmen's Benevolent Association of the City of Beacon

 

The January 1, 2005 through December 31, 2006 Collective Bargaining Agreement is hereby modified as follows, except for editorial changes, such as dates, renumbering, etc. as necessary. The negotiating committees for the City of Beacon and the PBA agree to recommend ratification and/or approval of this Memorandum to the City of Beacon and the PBA membership.

 

1.    Term - January 1, 2007 through December 31, 2009.

 

2.    Wages.

                a.                      Effective January 1, 2007 - 4.0% added to the salary schedule.

                b.                      Effective January 1, 2008 - 4.25% added to the salary schedule.

                c.                             Effective January 1, 2009 - 4.5% added to the salary schedule.

 

3.              Grievance Procedure - As agreed by the parties.

 

4.              Comp Time - Modify and conform to 48-hour limitation.

 

5.              Vacation/Longevity - Convert 17th year vacation to 17th year longevity of $2000 plus
1.92% of officer's appropriate rank rate of pay. Eliminate IX.F. from contract.

 

6.              Random Drug and Alcohol Testing - Language to be agreed.

 

7.              Retiree Health Insurance Conversion - Subject to the limitations of the terms of the
collective bargaining agreement, the value of any time accruals available at time of
retirement may be used to pay the retiree's health insurance premium cost, at the
officer's option.

 

8.              Detective On-Call - Replace current provision with one providing the detective who serves on-call with a $100 per week payment.

 

9.              Ordered Overtime - Clarify current language so that double time is paid only to an officer who is ordered held over to work overtime beyond his eight-hour shift.  If an off-duty officer is ordered in for anything other than a normal tour of duty, they will receive time and one-half for the overtime worked.
